The fees for the notarial acts of a notary are regulated by the Notary Fees Act, and the fees are the same for all notaries in Estonia. If a person\u2019s financial circumstances do not allow them to pay the notary fee, it is also possible to apply for an exemption from the fee.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

About the fees<\/h2>\n

The notary fee covers both the performance of the notarial act and the provision of related legal and technical services, for which the notary is paid. The notary fee is usually calculated on the basis of two general principles: it either depends on the transaction value of the notarial act or is a fixed amount. VAT is always added to the notary fee.<\/p>\n

How are the fees dependent on transaction value calculated?<\/h3>\n

The transaction value is determined by the value of the item or right that is the object of the notarial act at the time the act is performed. The value is the amount declared by the persons requesting the transaction.<\/p>\n

For example, if a property is sold for \u20ac50,000, the transaction value is \u20ac50,000. The same applies when this property is gifted, as the transaction value depends on the value of the property, not on the type of transaction.<\/p>\n

When a mortgage is created or deleted, the transaction value is two-thirds of the mortgage amount.<\/p>\n

In the case of the memorandum of association or foundation resolution of a private limited company or a public limited company, the transaction value is the amount of the proposed share capital.<\/p>\n

If the value of the asset or right declared by the contracting parties is lower than its market value, the transaction value will be determined on the basis of the land\u2019s taxable value, the amount of the mortgage entered in the Land Register, the value of the building entered in the Register of Construction Works, the sum insured of the asset or right, or other reliable data, such as the market price.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t
